DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF DVDFLIX.CA LIABILITY

The DVDFlix.ca Web site and its contents are provided "as is". No warranties or representations of any kind are made regarding the DVDFlix.ca web site or its contents. We assume no liability or responsibility for errors, omissions, failures, delays in delivery, or interruptions regarding the content of the DVDFlix.ca Web site or any losses or damages arising from the use of the DVDFlix.ca web site, or any conduct by users of the DVDFlix.ca web site. DVDFlix.ca does not represent or warrant that the information accessible via our site is accurate, complete or current.

DVDFlix trademarks may not be used in connection with any product or service not contractually affiliated with DVDFlix in any manner that discredits or disparages DVDFlix.ca and DVDFlix, Inc. Other trademarks or images not owned by DVDFlix that appear on the DVDFlix.ca Web site remain the sole property of their respective owners, who may or may not be affiliated with DVDFlix.ca or DVDFlixInc.

COPYRIGHT:

All content on the DVDFlix.ca Web site, including graphics, text, logos, audio clips, photographs, images, video clips, downloaded files and software remain the property of DVDFlix, Inc. or its suppliers and is protected by Canadian and International copyright laws. All content on the DVDFlix.ca web site shall remain the exclusive property of DVDFlix, Inc. and cannot be reproduced or used without prior written permission from DVDFlix, Inc.

QUALIFICATIONS FOR USING THE DVDFLIX SERVICE:

In order to be able to use the DVDFlix.ca service, you must meet the following requirements:

1. You must have access to the Internet
2. You must be at least 18 years old
3. You must have a Canadian residence with valid Postal Code
4. You must have a valid Credit Card

CUSTOMER PRIVACY:

All of the information given to DVDFlix.ca by our customers is held under our privacy policy. Our privacy policy is explained in detail by clicking the Privacy Policy tab located at the bottom of the page.

REVISIONS:

DVDFlix.ca reserves the right to revise these Terms of Use at any given time. We recommend that you check the Terms of Use each time you visit the DVDFlix.ca website. We will post the date of revision each time we update it.

USE OF INFORMATION:

By accepting these Terms as a member of DVDFlix.ca, you agree not to use any information contained in the DVDFLIX website, or from the links to this site, in any legal action (such as claims, lawsuits, actions, etc.) against DVDFlix.ca or any of its affiliates, sponsors or suppliers. You may not use this information for anything other than your own personal, and non-commercial use. Any failure to adhere to these Terms regarding use of information will result in the immediate termination of membership and service.

DVDFLIX RESERVATIONS:

DVDFlix.ca reserves the right to suspend or terminate your service with or without prior notice to you.

MEMBERSHIP TERMS:

Your account profile will give you detailed information regarding the stats of your free trial period and the status of your subscription.

THE FREE TRIAL PERIOD:

The Free Trial is only available to new customers of DVDFlix.ca and the Free Trial cannot be combined with other offers. Only one free trial membership may be redeemed per household. It is necessary to have a credit card and access to the Internet in order to qualify for the free trial. The free trial entitles you to the same fast, friendly service that our paying subscribers receive. Once redeemed, all promotional offers are final and are not eligible for refund or return.

We will bill your credit card the monthly fee of $19.99 CDN (plus applicable taxes) only after the trial period has expired. Billing will continue on a monthly basis, until your membership is cancelled by either DVDFlix.ca or by you. Please remember that you must cancel before the trial period ends in order to avoid charges to your credit card.

During the free trial period, you can rent as many DVDs as you want. (Up to three DVDs at a time.) Your subscription can be cancelled at anytime at your request.

MONTHLY FEES FOR USING THE DVDFLIX SERVICE:

If it is necessary to change your mailing address or credit card number you can edit and submit the changes in the customer profile section of your membership when you sign in to the DVDFlix.ca homepage. If you decide to cancel, you must cancel before the next billing cycle to avoid subsequent charges to your credit card.

TERMINATION OF MEMBERSHIP:

As a member of DVDFlix.ca, if you decide to cancel, you must cancel before the next billing cycle to avoid subsequent charges to your credit card. Under the Terms of Use, you understand that after terminating your subscription, you will have TEN business days to return all out standing DVD rental items in your possession. By your acceptance of these terms when you joined as a member of DVDFlix.ca, you hereby agree to authorize DVDFlix.ca to bill your credit card for the losses incurred by your failure to return all outstanding DVD rental items in your possession after the ten business days has passed from the date of the termination of your membership.

CUSTOMER CONDUCT:

By using the DVDFlix.ca website, you agree not to perform any actions which will cause damage, delays or interruptions to the services provided by DVDFlix.ca. You agree that you will not in any way use any invasive or destructive programs designed to disrupt, damage or destroy the operations of the DVDFlix.ca website. As members of DVDFlix.ca, you agree that you will not impersonate any other person while you are using the DVDFlix.ca website. Furthermore, you agree not to conduct yourself in a vulgar, offensive manner or use the DVDFLIX website for criminal purposes.
